Solihull Council Triumphs in Planning Appeals After Recent Setbacks

Solihull Council is currently experiencing a welcome turnaround in its planning appeals record, securing five significant wins after a string of recent losses. These victories not only uphold the council’s planning decisions but also prevent additional costs from being passed on to taxpayers.

After a challenging period marked by four lost planning appeals within a matter of weeks—which also prompted criticism regarding the council’s conduct—the tide is turning. Recent decisions by the government’s Planning Inspectorate have sided with the council, reinforcing its authority and planning policies.

Among the successful appeals, applicants had sought approval for developments such as a property extension in Shirley, another home extension in Knowle, and the construction of a new wall and gate on Lovelace Avenue. Despite these approvals, the council managed to defend five appeals where the inspectorate ruled against the applicants.

The latest appeal report, prepared for the council’s planning committee meeting on May 27, highlights these dismissed appeals:

  • Fencing installation that was deemed to harm the character of the street scene.
  • An application involving the removal of a tree, where the inspector agreed with the council that felling the tree would significantly damage the area’s character despite claims the tree was causing garden usability issues and trip hazards.
  • A development application refused on grounds that it did not qualify as permitted development; the inspector endorsed the council’s view that removal of restrictions was necessary to prevent uncontrolled and potentially inappropriate site development.
  • A condition imposed by the planning committee last July, requiring the removal of certain structures for highway safety reasons, was upheld by the inspector as both necessary and reasonable.

These decisions underscore the council’s commitment to orderly development and neighbourhood character preservation. Members and officials alike can take reassurance in the alignment between their decisions and the Planning Inspectorate’s findings.
