A claimant seeking Personal Independence Payment (PIP) was awarded an additional tribunal after a judge identified legal errors in their initial hearing, highlighting challenges within the benefit appeal system.
The claimant first applied for PIP in May 2023, a benefit designed to assist individuals with medical conditions in covering living costs. After a delayed response in September 2023, their claim was refused, despite being awarded four points in the ‘Engaging with other people’ category. Dissatisfied, they requested a mandatory reconsideration (MR), which was also denied.
Determined to continue their fight, the claimant lodged an appeal with the courts in December 2023, leading to a tribunal hearing set for July 2024. However, a national IT outage forced an adjournment. When the appeal hearing finally took place in August 2024, the tribunal upheld the initial denial, leaving the claimant feeling as though the process had reached its end.

Undeterred, in November 2024 the claimant sought permission to appeal to the upper tribunal, citing overlooked legal errors in the first-tier tribunal’s decision. Although their request was initially rejected by a district judge in February 2025, they successfully petitioned to appeal directly to the upper tribunal.
In June 2025, an upper tribunal judge granted permission to appeal, agreeing that errors of law had occurred during the first hearing. This decision led to a second first-tier tribunal, which took place in January 2026. The claimant was awarded an additional two points in the daily living category, bringing their total to six. Unfortunately, this fell short of the eight points required to qualify for the standard PIP rate.
Reflecting on a three-year battle, the claimant expressed deep disappointment but encouraged others facing similar struggles not to give up. They praised the support community for their invaluable assistance throughout the process, while acknowledging the emotional toll of the lengthy appeals.
