New Salary Transparency Rule Proposed to Combat Pay Discrimination in England

The UK government is proposing new legislation that would require companies to publish salary details in job adverts, aiming to tackle pay discrimination and enhance equal pay protections. This move could potentially benefit millions of workers nationwide by promoting greater pay transparency.

The Office for Equality and Opportunity has opened a consultation to gather input on reforming the current equal pay framework, with an emphasis on improving outcomes for workers, businesses, and the justice system. The consultation particularly focuses on addressing gaps that adversely affect disabled individuals, ethnic minorities, and outsourced workers.

A spokesperson explained that the proposed pay transparency measures intend to shift the approach from reactive legal battles to proactive prevention. Encouraging employers to identify and resolve pay disparities early on would not only help them comply with the law but also reduce the number of discrimination claims. This early intervention strategy aims to ease the burden on employees, employers, and the courts.

The government acknowledges existing inequalities within the system, noting that rights and protections are currently inconsistent across groups facing discrimination based on sex, race, or disability. Additionally, outsourcing arrangements sometimes allow employers to circumvent equal pay obligations. The initial focus is on improving the current framework, with plans to introduce further measures to close these gaps once foundational reforms are in place.

The consultation is open until 5pm on 27 October 2026. Ministers will review the feedback before finalizing the legislative requirements applicable to employers in England, Scotland, and Wales.
