Mother Confronts Son After Fatal Hit-and-Run, Leading to Conviction

In a tragic incident on March 4, 2024, 25-year-old David Brown struck 81-year-old James Atkinson with his car, leaving the elderly pedestrian with fatal injuries. Mr. Atkinson, a seasoned trumpet player heading to band practice, was crossing Teehey Lane in Bebington when Brown’s BMW 1 Series hit him. The impact caused catastrophic injuries, and despite medical efforts, Mr. Atkinson passed away two days later.

Brown initially left the scene and went to his mother’s flat for dinner. Overwhelmed by the situation, his mother returned with him to the accident site and subsequently provided crucial testimony against him during the trial at Liverpool Crown Court.

The prosecution revealed that Brown was driving aggressively, accelerating past parked cars at speeds estimated between 39 and 42 mph in a 30 mph zone, on a dark and rainy evening. After the collision, Brown only briefly slowed down before continuing to his mother’s home. He later expressed panic and confusion, claiming he didn’t see Mr. Atkinson due to poor visibility and vehicle blind spots.

Despite having no prior convictions, Brown was found guilty of causing death by dangerous driving and admitted to failing to stop after the accident. During sentencing, Judge Anil Murray emphasized the avoidable nature of the tragedy, highlighting Brown’s failure to maintain proper lookout and abide by speed limits in a busy residential area.

The judge acknowledged the pain caused to both the victim’s family and Brown’s mother, who acted honorably by bringing her son back to take responsibility. Brown was sentenced to four years in prison, banned from driving for seven years, and will face an extended driving test before regaining his license.

Brown’s defense pointed to his immaturity and learning difficulties, including dyslexia, and noted his remorse. However, the court found his remorse undermined by continued denial of full responsibility.
