Midlands Motorway Drivers Beware: Understanding the 51mph Speed Limit Rule

Thousands of motorists in the West Midlands have faced fines after inadvertently breaking temporary speed limits on motorways. These speed restrictions, often displayed on digital gantries along smart motorways like the M6, are designed to improve safety during congestion, incidents, or roadworks—but they can be confusing for drivers.

Traffic volumes in the region frequently cause congestion, prompting authorities to reduce speed limits from the national 70mph to 60, 50, or even 40mph, depending on conditions. These limits are mandatory, not advisory, yet many drivers mistakenly believe they are suggestions and fail to comply.

The consequences of ignoring these limits can be severe. Variable speed cameras enforce these temporary restrictions rigorously. For example, driving at 51mph in a 50mph zone could result in a fine, although enforcement discretion may sometimes be applied. Nonetheless, relying on leniency is a risk drivers should avoid.

In the West Midlands, hotspots for these infractions include the M6 between junctions 7 and 8 near Great Barr, and between the M54 exit slip road near Wolverhampton and junction 10 near Walsall. Thousands have been penalised in these areas over the past few years.

Drivers must also respect temporary speed limits during roadworks. Reports indicate some motorists have been fined for exceeding 50mph restrictions on the M42 at Water Orton, where HS2 viaduct construction is underway, though official confirmation from West Midlands Police remains unavailable.

Understanding and obeying these fluctuating speed limits on smart motorways is critical to avoiding fines and enhancing road safety for all.
