Grieving Birmingham Driver Receives Three-Year Ban Following Collision

A Birmingham man, Shamarie Wedderburn, has been disqualified from driving for three years after a collision in May revealed he had been under the influence. Police attending the scene noted the strong scent of alcohol and discovered several bottles of wine and cider inside his vehicle.

Wedderburn, 34, from Church Lane, Nechells, was struggling with the recent and sudden death of his father in February, his solicitor explained at Birmingham Magistrates' Court. Despite his attempts to comply, Wedderburn was unable to provide a breath specimen for analysis, leading to charges.

His solicitor emphasized his efforts, stating, “It is clear from the CCTV footage that he was attempting to blow into the breathalyzer, but could not complete the process.” However, prosecutors highlighted the visible signs of intoxication, including bloodshot, watery eyes, and noted that Wedderburn was observed sucking on the breathalyzer rather than blowing.

A search of his car uncovered nearly two bottles of wine (one partially empty), a bottle of cider, and another full bottle of wine. The court was also informed of a previous drink-driving conviction from six years ago.

The defense stressed the emotional distress Wedderburn was experiencing due to his father’s unexpected passing and the consequent impact on his life, including suspension from work. “He is a full-time customer service worker who is finding it very difficult to cope,” the solicitor said.

Presiding magistrates acknowledged the severity of the offense, particularly given Wedderburn’s prior record, and imposed a 36-month driving ban. In addition to the ban, Wedderburn was fined £110 and ordered to pay a total of £471 in costs.
