Original Khyber Ltd, a new restaurant located at 20 Alum Rock Road, Birmingham, has submitted an application to Birmingham City Council for a premises licence to offer late-night refreshment. The proposal seeks to allow the service of hot food and drinks indoors from 11pm until 1am, every day of the week.
This application, governed by the Licensing Act 2003, specifically covers the preparation and sale of hot food or hot beverages to the public between 11pm and 5am. It does not include the sale of alcohol or provision of regulated entertainment. If approved, Original Khyber would operate their late-night refreshment service across all seven days, strictly indoors.
Residents, local businesses, and other stakeholders are encouraged to review the application and submit any representations or concerns by 22 May 2026. Comments should address the licensing objectives, which focus on preventing crime and disorder, ensuring public safety, reducing public nuisance, and protecting children from harm. Written representations can be sent to General Licensing, Regulation and Enforcement at PO Box 17831, Birmingham, B2 2HJ or emailed to [email protected].

The application documents are available for public inspection during normal office hours at the licensing authority’s offices. The original public notice also provides further details online.
Late-night refreshment licences enable businesses to extend their food service offerings into the late hours, benefiting customers seeking food after 11pm. However, the council considers potential impacts on the surrounding community—such as noise, litter, traffic, and parking—and may impose conditions to mitigate any issues.
Decisions on licence applications are made by Birmingham City Council, either by designated officers or a licensing sub-committee if necessary.
